Board of County Commissioners Hearing on Proposed Lyons Ridge Rezoning - April 15, 2008

The second session of hearings before the Board of County Commissioners (BCC) on the proposed Lyons Ridge rezoning was held on April 15, 2008. Following another two hours of testimony (there were many excellent presentations opposing the rezoning), Commissioner McCaskey asked Tim Carl, Jefferson County Director of Transportation and Planning, to make a PowerPoint presentation on the rezoning.

Part of this presentation involved a slide showing three possible scenarios for the BCC to consider. Oddly, neither the Planning Commissioners recommendation of 215 lots, nor the SJCCP recommendation of 115 lots was one of the scenarios. The presentation, which had been prepared at the direction of Commissioner McCaskey between the April 3 hearing and the April 15 hearings, proposed a "compromise" of 230 lots (total for both use areas).

At the conclusion of this presentation, Commissioner McCaskey made a motion that the applicant meet with the staff in the next few weeks to refine the Written Restrictions for a development totaling 230 lots. The resolution included a provision that the abandoned campus be demolished by December 31, 2008. The motion was made to "continue" the hearing until June 10.

Commissioner Kathy Hartman voted in favor of continuing the hearing but made it clear that the density proposed in the resolution was too high. She added that she would support the effort to include the design guidelines. The motion to continue was approved by all three Commissioners.
The applicant is required to resubmit the revised ODP within 21 days prior to the June 10 hearing. The revised ODP will be referred to the community HOAs.
Anyone wishing to speak at the June 10 hearing will be permitted to speak.

The Hogback Conservancy Coalition (HCC) is very concerned that Commissioner McCaskey made a decision PRIOR to the hearing and the consideration of ALL the testimony. Since rezoning actions are quasi-judicial proceedings, it is clearly improper to make a decision prior to hearing the complete testimony.

The HCC will provide an update once the revised ODP has been submitted, and will again be asking for people to testify at the June 10 hearing.

FINAL HEARING

APRIL 15, 2008

The Jefferson County Board of County Commissioners will hold a hearing on April 15th, 2008 at 6pm concerning the Lyons Ridge ODP. They will hear FINAL TESTIMONY and will most likely make their decision concerning the Lyons Ridge rezoning.

BOARD OF COMMISSIONERS HEARING

APRIL 3, 2008

The Jefferson County Board of County Commissioners held a hearing on
April 3, 2008 at 6pm concerning the Lyons Ridge ODP. The Planning and
Zoning staff made their presentation and AGAIN recommended DENIAL "based on
the criteria set forth in the Community Plan" regarding subareas,
visual resources and design guidelines.

The applicant made their presentation, followed by an impressive list
of speakers representing the Hogback Conservancy Coalition. The Hogback
Conservancy Coalition (HCC) is an organization comprised of eleven
homeowner associations, as well as Red Rocks County Club and the Willow
Springs Open Space Owners Association. The HCC represents over 1,000
homes and over 2,000 Jefferson County residents in the area west of
the Dakota Hogback, south of US Hwy 285 and north of Ken Caryl North
Ranch.

Over a dozen HOA representatives and residents spoke on the subjects
of: the integrity of the SJCCP (South Jefferson County Community Plan),
failure of ODP to meet criteria for Plan Exceptions, removal of
existing campus, ODP densities vs. densities along Belleview and
throughout community and impact on rural character. Property rights
issues and design guidelines were also leading topics.

The Commissioners decided at 9pm to "continue" the hearing until April
15th at 6pm when the remaining testimony will be heard and a decision
will be made.

County Commisioner Hearing

The hearing before the THREE County Commissioners will be held on THURSDAY, APRIL 3 at 6PM.

Report on PLANNING COMMISSIONERS HEARING

At a meeting held March 12th, the Planning Commissioners voted 5-2 to adopt a motion to approve rezoning,with some conditions.

The motion was introduced by Commmissioner Spanstra, based on a red-lined
version of the ODP prepared by Commissioner Johnson. The Commissioners
deliberated for an hour and a half.There was no public testimony. The major
issue discussed was density, with comments and recommended conditions to be
placed on wildlife corridors, minimum lot sizes, water tanks, removal of
current campus, setbacks and privacy fencing.

The bottom line: The ODP allowed for a maximim of 280 units in Use Areas 1 & 2. THE PLANNING COMMISSIONERS MOTION APPROVED WAS FOR 75 UNITS IN USE AREA 1 (Valley) AND 140 UNITS IN USE AREA 2 (Old Campus). This recommendation reduces the density from the ODP to a level which is STILL 95.4% MORE THAN RECOMMENDED BY THE SJCCP.

This decision was AGAINST their own P & Z Staff recommendation of DENIAL.
Most of the Commissioners did not seem to be concerned with maintaining the
integrity of the newly-revised and adopted South Jefferson Çounty Community
Plan, the community planning process, or about whether or not the ODP meets
the Plan Exception criteria. The Commissioners seemed overly concerned with
compromise.
